Terms and Conditions Preface
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“you”, “your”, or “User”) and Fluent Gas Ltd (“Tivy”, “we”, “us”, or “our”), the developers of the Tivy mobile application (“the App”). Tivy is an application designed to assist qualified engineers in performing gas system testing and calculations aligned with UK gas safety regulations.
1. Acceptance of Terms
By downloading, installing, or using Tivy, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the app. By using Tivy for any gas testing, purging, commissioning, certificate, or related gas work, you confirm that you are legally permitted, competent, suitably trained, and appropriately qualified to carry out that work.
2. Description of Service
Tivy is a digital tool designed to assist qualified gas engineers with calculations related to gas installations, purging, testing procedures, and gas certificate generation. The App provides numerical outputs, UP1 tightness test pass or fail indicators, and certificate content based on user inputs and industry-standard formulas. UP1 tightness test pass or fail indicators are calculation aids only and are based solely on information entered by the user.
3. Limitation of Liability
The information provided by Tivy is intended for general guidance only. While Tivy is designed to provide calculations based on recognised industry methodologies, all outputs, reports, pass or fail indicators, and gas certificates are generated from information entered by the user and must be independently reviewed, verified, completed, and interpreted by a qualified and competent gas engineer before reliance is placed on them, before use, and before issue. Tivy accepts no liability for decisions, actions, omissions, declarations, certificate contents, safety conclusions, or compliance outcomes arising from the App’s outputs or from information entered by users. Users cannot hold Fluent Gas Ltd liable for damages resulting from app crashes, errors, incorrect inputs, incomplete inputs, certificate errors, calculation indicators, or service interruptions. Crash data may be collected and transmitted to Firebase for diagnostic purposes. For more details, please refer to our Privacy Policy at https://get.tivy.app/privacy. You agree that Fluent Gas Ltd shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App. Access to the App requires an active subscription. 4. User Responsibility
- Qualified Users Only: Tivy is intended only for competent gas engineers and suitably qualified users. Where required by law, you must hold current Gas Safe Register registration and all relevant certificates, qualifications, categories, and evidence of competence for the specific gas work being carried out, including any applicable ACS certificates of competence or other recognised qualifications.
- Assistant Only: Tivy is an assistant to your own training, knowledge, experience, competence, and professional judgement. It is not a replacement for any qualification, certification, registration, training, standard, procedure, manufacturer instruction, legal duty, or site-specific assessment.
- Professional Responsibility: You are solely responsible for interpreting and verifying any values or calculations generated by the App.
- UP1 Tightness Test Indicators: Where Tivy displays a pass or fail indicator for a UP1 tightness test, that indicator is based only on the engineer’s inputs, including the relevant area type, maximum permissible leak rate values, calculated maximum permissible leak rate, and calculated actual leak rate. The indicator does not confirm that any installation, appliance, pipework, system, site, or work is safe, compliant, complete, suitable for use, or fit for service.
- Independent Verification: You must independently check all UP1 tightness test inputs, calculations, pass or fail indicators, readings, conditions, procedures, and results before relying on them, issuing any certificate, or making any safety or compliance decision.
- Gas Certificates: You are solely responsible for all information entered into gas certificates, for reviewing certificate content before issue, and for ensuring each certificate is accurate, complete, compliant, and suitable for its intended use.
- Engineer and Business Details: You are solely responsible for ensuring any Gas Safe, employee, name, business, address, telephone, mobile, and logo details entered for certificate creation are accurate, current, and authorised for use.
- Compliance: You are responsible for ensuring that all work complies with current laws, regulations, and standards applicable in your jurisdiction.
- Professional Judgement: Any pass or fail indicator shown by Tivy is not professional advice, a safety certification, a compliance decision, or a substitute for your professional judgement.
5. Use of Information
- General Guidance: The information provided by Tivy is for general guidance only and should not be interpreted as professional advice.
- No Endorsement: Any references to specific standards, organizations, or tools are for informational purposes only and do not constitute endorsements.
- External Resources: Links or references to third-party resources are provided for convenience. Tivy does not guarantee the accuracy or reliability of such resources.
- No Affiliation: Tivy is an independent product and is not affiliated, endorsed, or approved by IGEM or any other regulatory authority.
6. Intellectual Property
All intellectual property rights in the App, including its software, design, branding, calculations, content, workflows, reports, certificates, and functionality, are owned by Fluent Gas Ltd or its licensors. No rights are granted except for the limited licence to use the App in accordance with these Terms.
7. Suspension and Termination
We reserve the right to suspend or terminate access to the App where we reasonably believe these Terms have been breached, where required by law, where payment or subscription access is invalid, or where continued access may present a security, legal, operational, or safety risk.
8. Force Majeure
Fluent Gas Ltd shall not be liable for failures, interruptions, or delays caused by events beyond its reasonable control, including outages, failures, cyber incidents, third-party service disruption, app store issues, payment processor issues, hosting provider failures, Firebase or cloud service disruption, legal restrictions, labour disputes, fire, flood, severe weather, or other events outside our reasonable control.
9. Updates to Terms and Conditions
Tivy reserves the right to modify or update these terms and conditions at any time without prior notice. Continued use of the app after changes are posted constitutes acceptance of the updated terms.
10. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
